Release and Waiver of Liability and Hold Harmless Agreement

The below listed GUEST(s) wish(es) to utilize and have access to the swimming pool(s), surrounding property and facilities, other than those areas limited to employee access only), owned by Blue Heron Lakes Swim & Tennis Club, LLC, (“BHLSTC”).

The GUEST(s) and BHLSTC agree that there are certain risks involved while swimming and/or engaging in related activities. In consideration of utilizing BHLSTC’s swimming pool, surrounding property, and facilities, the GUEST(s) agree(s) to waive all liability and release BHLSTC from any liability whatsoever arising from the use of the swimming pool, surrounding property and facilities by the GUEST(s).

The GUEST(s) waive(s) all claims, demands, causes of action, or judgements for any loss including but not limited to, any loss arising from bodily injury, personal injury or drowning which they and/or their heirs, executors, administrators or assigns may have against BHLSTC, its owners, employees, or agents, for personal injury or damage to property caused by or arising out of the GUEST(s) use of BHLSTC’s swimming pool(s), surrounding property and facilities.

The GUEST(s) agree(s) to indemnify and hold BHLTC harmless for any claims of loss, including but not limited to any loss arising from bodily injury, personal injury or drowning from the GUEST(s) use of BHLTC’s swimming pool(s), surrounding property and facilities.   

The GUEST(s) agree(s) that BHLSTC will not be responsible for any personal property items lost or stolen from GUEST(s) while on the premises of BHLSTC.
